Terms & Conditions (KTRADE LLC / SkyUnity)
1. Scope of Services KTRADE LLC, operating under the brand SkyUnity, provides aerial photography, videography (including FPV), post-production, and related media services. All services and deliverables are defined in the signed service order, invoice, or membership/subscription summary.
2. Booking, Deposit & Payment
A booking is considered confirmed once the client signs the service order, unless otherwise agreed in writing. The remaining balance is due upon delivery of final media or on the day of service, as stated on the invoice. Accepted payment methods: card, cash, check, Google Pay, Apple Pay, PayPal. Late payments may incur interest up to 1.5% per month or the maximum rate allowed under North Carolina law, whichever is lower.
3. Cancellations & Rescheduling
Cancellations made more than 3 days before the scheduled shoot: the deposit may be transferred to a new date within 90 days or refunded minus $25 (administrative fee). Cancellations made within 3 days due to client fault will forfeit the deposit and may incur additional costs. SkyUnity may reschedule flights due to weather, airspace restrictions, or safety concerns. If rescheduling is not possible, the client will be offered a full refund, credit, or alternative date at no additional charge.
4. Client Responsibilities & Access
The client must provide safe and legal access to the property, identify potential hazards, and secure any required permissions for operations on private or controlled premises. When filming near people, buildings, or third-party property, the client is responsible for obtaining any required consents. Clients must inform SkyUnity of any HOA rules, local regulations, or venue restrictions before the scheduled shoot.
5. Permits, Airspace & Lawful
Operations SkyUnity operates in full compliance with FAA Part 107 and applicable U.S. aviation laws. Clients shall not request illegal, unsafe, or non-compliant flights. Any additional permissions (e.g., municipal filming permits or restricted-airspace waivers) are the client’s responsibility unless otherwise agreed in writing.
6. Delivery, Revisions & Turnaround Standard turnaround time is 7 to 14 business days after the shoot, unless otherwise specified. One round of minor revisions is included. Major revisions or changes beyond the agreed scope may be billed at an hourly rate.
7. Intellectual Property & Usage Rights
Unless an exclusive license is purchased, all copyrights remain with KTRADE LLC / SkyUnity. Upon full payment, the client receives a non-exclusive, perpetual license to use the delivered media for the purposes outlined in the service order. Redistribution, resale, or sublicensing beyond the permitted uses constitutes copyright infringement and may result in legal action. SkyUnity may use completed media for portfolio, marketing, and social media purposes unless the client opts out in writing before booking.
8. Confidentiality
SkyUnity will not disclose any client confidential information except as required by law. Promotional use of final deliverables is permitted under Section 7 unless a separate NDA is executed.
9. Liability Limitation & Indemnity To the fullest extent permitted by law, SkyUnity’s liability for any claim arising from the services is limited to the total amount actually paid by the client for that specific service. The client agrees to indemnify and hold SkyUnity harmless from any claims, losses, or damages resulting from the client’s breach of these terms or related actions.
10. Insurance SkyUnity maintains General Liability Insurance and Drone Liability Insurance covering operations within North Carolina. Proof of insurance is available upon request.
11. Termination
Either party may terminate the agreement for material breach if the breach is not cured within 14 days after written notice. All fees for work performed up to the termination date remain payable.
12. Governing Law & Disputes
The laws of the State of North Carolina govern these terms. Any disputes shall be resolved in the Mecklenburg County Courts or through binding arbitration, as mutually agreed.
13. Modifications
KTRADE LLC / SkyUnity may update these terms from time to time. Changes take effect upon posting; significant revisions will be communicated to active clients.
